Scope These general terms and conditions (T&Cs) apply to all contracts concluded via our online shop between Betterguards Technology GmbH (hereinafter referred to as "Betterguards") and our customers.
Contracting Party and Conclusion of Contract The purchase contract is concluded with Betterguards Technology GmbH, Eiswerderstr. 20A, 13585 Berlin, Commercial Register: HRB 160382, Charlottenburg District Court. By ordering goods, the customer submits a binding offer. A contract is only established through our confirmation via email or by dispatch of the goods.
Prices and Payment Terms All prices include statutory VAT. Standard shipping within Germany is included. Additional charges for shipping outside Germany and express surcharges, if applicable, are shown separately during the purchasing process. Payment options include American Express, Apple Pay, Google Pay, Klarna, Maestro, Mastercard, PayPal, Shop Buy, Sofortüberweisung, Unionpay, and Visa.
Delivery and Shipping Conditions Deliveries are only made within the European Union to the shipping address provided by the customer. Delivery within Germany takes 1-3 business days after order receipt, unless otherwise agreed. Delivery times within the European Union may vary. Any deviations in delivery times will be indicated at purchase or, if applicable, in the order confirmation.
Right of Withdrawal and Returns Consumers have the right to withdraw from this contract within 21 days without providing any reason, according to our right of withdrawal/return policy. The withdrawal period begins upon receipt of the goods. To exercise the right of withdrawal, a notification to our support at +49 (30) 4220669-100 or info@betterguards.de is sufficient. Betterguards will cover the cost of return shipping. After inspecting the returned goods, we will refund the purchase cost (including standard shipping). The refund will be made using the same payment method used in the order. If the value of the goods is diminished due to use beyond what is necessary to inspect them, Betterguards reserves the right to claim reasonable compensation for the loss in value.
Retention of Title The goods remain our property until full payment has been received.
Warranty and Liability The statutory warranty applies. We are not liable for damages caused by improper use of the goods. Our liability for minor negligence is excluded, except for breaches of essential contractual obligations.
Data Protection Your personal data will be used solely for the processing of your order and will not be shared with third parties, unless necessary for order fulfillment (e.g., shipping providers). Further information can be found in our Privacy Policy.
Final Provisions German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the company, provided the customer is a business customer. The contract language is German. If T&Cs are available in other languages, the German version is binding. If any provision of these T&Cs is invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the legally permissible provision that most closely approximates the economic purpose of the invalid provision. We reserve the right to amend these T&Cs for the future.
